Definitions

This document establishes the conditions that will govern the use of the technological solution, Gésumé (hereinafter “the Application”), that comprises web portals and mobile applications that are developed and also published by Yopaat BV (hereinafter “the Provider”). A natural person (hereinafter “the User”) accessing, downloading, installing the Application and/or interacting with the Application, may be performing such “Use”.

Base Conditions

The User agrees to read the terms and conditions established here by accessing, downloading and installing the application on their computing and communication devices. Therefore, by accessing, downloading and/or installing the Application, it is assumed that the User has read and fully accepted the terms and conditions detailed in this document.

The User acknowledges that they provide any data, including personal data voluntarily through the use of the Application. Those using the Application from outside the European Union do so on their own initiative and will be responsible for compliance with applicable local laws.

Minors who access the Application must have adult supervision at the time of download, installation and use of the Application. Where it is not possible to fulfill this obligation, the application should not be used.

Users and Clients are allowed and facilitated to use the application, based on the commercial and technical terms offered by the Provider and agreed by the User or the Client.

Purpose of the Application

The application is intended to be accessed and used on computing devices, such as personal computer and smartphones, supporting web-based content and functionality portals, for the purposes of

  • The Users to create their personal accounts & profiles comprising information about their professional skills, experiences, and qualifications
  • The Users to create and publish content by adding textual and multimedia elements
  • The Users to read and view content published by other Users
  • The Users to interact with other Users by messaging and sharing their published content
  • The Users to define and publish vacancy definitions that correspond to the professional work positions that themselves or their affiliated organizations might be looking to fill
  • The Users to find and analyze vacancies and potential candidates to fill vacancies
  • The Users to invite other Users to join the Application by opening accounts and building personal profiles

Conditions of Conduct

The Provider reserves the right to remove the activation of Users, at an event that they demonstrate harmful behavior and/or use offensive language in communications channels provided by the platform.

In the same way, the User may not (i) introduce, store or disseminate any program, data, virus, code, or any other electronic or physical device that is likely to cause damage to it or transmit in any other way any content that it may be contrary to law or public order; (ii) introduce any content that is harmful, abusive, derogatory, defamatory, obscene, invasive or private, racist, xenophobic, or practice any objectionable behavior; (iii) introduce or disseminate any content without legally accrediting the rights necessary to do so (for example, the information within a company, proprietary and confidential learned or disclosed as part of employment relationships or under the terms of contract agreements) Likewise, the User is prohibited from introducing or spreading any commercial or advertising content; (iii) introduce, store or disseminate through the application any material that contains viruses or any computer code such as files or programs designed to interrupt, destroy or limit the functionality of any software, hardware or telecommunications equipment, as well as data, viruses, code , or any other electronic or physical device that is likely to cause damage to it, any of the services, or any of the equipment, systems or networks of the Provider, of any other User, or, in general, from any third party; (iv) alter, copy, download, modify, decompile, disassemble, reverse engineer, license, lease, sell, or imitate the applications, their content, or their underlying software; (v) introduce, store or disseminate through the application any content that infringes industrial and / or intellectual property rights or business secrets of third parties, nor in general any content which, in accordance with the law, did not have the right to make it available to a third party.

Property Law

The User acknowledges that the contents of the application are protected by copyright, trademarks, or different forms of property law. Such content includes, among others, texts, software, photographs, videos, graphics, etc.

Therefore, the User of the application must refrain, without the prior written authorization of the Provider, from publishing, disseminating or marketing in any form or by any means, totally or partially, the information contained in the application and web links, under penalty of incurring liability for copyright infringement, in accordance with current regulations.

Data Protection Policy

The Provider will protect Users' personal data and will use it only to the extent permitted by law or provided that Users have given their consent. Users can find more information about it in the Privacy Policy.

Limitation of Liability

To the maximum extent permitted by applicable law, the User assumes no contractual or non-contractual liability for direct, indirect, incidental, special or consequential damages (even if it had been warned of the possibility of the same) ) that bring a cause of (i) use or inability to use the service; (ii) unauthorized access or alteration of your data transmissions; (iv) statements or conduct by third parties through the service.

The Provider is not responsible for the damages that may derive from interferences, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operational operation of the electronic system or in the computer devices and equipment of the Users, motivated by causes beyond the User, that prevent or delay navigation through the Application, or delays or blockages in use caused by deficiencies or overloads of the Internet or other electronic systems, or the inability to provide the service or allow access for causes not attributable to the Provider, due to the User, third parties, or force majeure.

Security

The Provider has implemented electronic and administrative procedures to protect and help prevent unauthorized access, prevent the loss, misuse, alteration, unauthorized access, and theft of your personal data.

Therefore, the User will be responsible for any damages that may be caused to the Provider or to any third party for the improper uses of the application, in accordance with the provisions of these conditions of use.

Competent Legislation and Jurisdiction

The policies and conditions of access and use established herein and the conflicts that may arise regarding its interpretation, use, scope, and termination are governed by the European Union law and are subject to the European Union judges and courts.

Changes in this Set of Terms & Conditions

The Provider reserves the right to update and amend this set of terms and conditions without prior notice and consent with the User. Such updates and amendments shall be in accordance with general principles of protecting the security and integrity of User data and other types of data, preserving the purpose and functionality of the technological solution and applicable law.
